Terms of Service

1. Acceptance of Terms

By accessing or using PopperAI (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Your continued use of the Service constitutes acceptance of any updates or changes to these Terms.

2. Description of Service

PopperAI is an AI-powered web application builder that allows users to describe applications in natural language, generate code using AI, preview applications in sandboxed environments, and deploy them with a single click. The Service may include features such as AI-assisted code generation, live preview, hosting, and deployment.

3. Account Registration

To use certain features of the Service, you must create an account. You must be at least 13 years old to use the Service. If you are under 18, you may only use paid features with the consent of a parent or legal guardian. You agree to provide accurate and complete information during registration, and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Create, distribute, or host illegal content
  • Generate malicious code, malware, or tools designed to harm others
  • Abuse or circumvent AI usage limits or safety measures
  • Scrape, reverse-engineer, or interfere with the Service
  • Misrepresent AI-generated output as solely human-created work in contexts where such disclosure is required
  • Violate the rights of any third party, including intellectual property rights
  • Use the Service for any purpose that is fraudulent or deceptive

PopperAI reserves the right to suspend or terminate accounts that violate these terms.

5. Intellectual Property

The Service, including its design, features, code, and branding, is owned by PopperAI and protected by intellectual property laws. You retain ownership of the content you create using the Service. Nothing in these Terms transfers ownership of PopperAI's platform, technology, or brand to you.

6. User Content & AI Output

You retain ownership of the prompts you submit and the code generated through your use of the Service. PopperAI may use anonymized and aggregated data derived from usage of the Service to improve and develop the platform. We do not use your personal projects to train AI models.

AI-generated output is provided "as is" without any guarantee of correctness, completeness, security, or fitness for a particular purpose. You are responsible for reviewing, testing, and validating all AI-generated code before use in production environments.

7. Payment & Billing

Paid plans are billed through Stripe on a recurring basis. By subscribing to a paid plan, you authorize PopperAI to charge your payment method on file. All fees are non-refundable. If you cancel your subscription, you will retain access to paid features until the end of your current billing period. Plan changes take effect at the start of the next billing cycle unless otherwise noted.

8. Usage Limits & Fair Use

PopperAI reserves the right to impose or modify limits on token usage, API calls, compute resources, storage, and any other service resources at any time, with or without notice. Usage limits may vary by plan and are subject to change. Excessive or abusive usage may result in temporary throttling or account restrictions.

9. Deployment & Hosting

Sites deployed through PopperAI are subject to the acceptable use policy and the terms of your current plan. PopperAI reserves the right to impose bandwidth or traffic limits, suspend, or remove deployed sites at any time for any reason, including but not limited to violations of these Terms, excessive resource consumption, or discontinuation of hosting services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. POPPERAI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPPERAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY. POPPERAI'S TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO POPPERAI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Termination

Either party may terminate this agreement at any time. You may close your account through your account settings. PopperAI may suspend or terminate your access if you violate these Terms. Upon termination, you may request an export of your data. PopperAI may retain certain information as required by law or for legitimate business purposes.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, Canada.

14. Changes to Terms

PopperAI reserves the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
